Frequently Asked Questions
The HSAC (Housing and Settlement Adjudication Commission) ruled that the increase was implemented without proper procedures and resident consultation. Because of this, they declared it null and void. This means residents may be entitled to a refund on the additional amount paid due to the increase.
However, there are important points to consider regarding potential refunds. First, while the HSAC decision is favorable, it needs to be upheld by both the Court of Appeals and Supreme Court for refunds to be guaranteed. Additionally, the timeframe of the overcharge impacts how you might receive your money back. If the excess collection extends beyond 4 years, DVA may be required to issue cash refunds. Otherwise, they may offer credit towards future association dues, potentially deducting the excess amount in full or through installments. It's important to note that DVA is currently contesting the HSAC decision and has legal representation.
